User Terms of Use

About us. Welcome to Dash Elevator. We connect our users to the elevators they ride using a variety of technologies. Please read these Terms of Use ("the Terms"): they govern your use of any of our products or services (the "Service(s)"), including interacting with our websites. We use the term Elevator to refer to all transporation equipment that interacts with the Service, including those for passenger, freight, dumb-waiters or other equipment with which we interact on your behalf.

You accept and agree. By using the Services in any part or way, including account creation via 3rd-party authentication, you are agreeing to be bound to the Terms of Use, and consider the Privacy Policy acceptable. If you don't agree to the Terms of Use, or find the Privacy Policy unacceptable, you may not use the Services or maintain an active account.

We will modify these terms. We may modify these Terms at any time by posting them to our website. It's important that you review the current Terms before continuing to use the Services: by continuing to use the Services in any part or way, you agree to be bound by the modified Terms. If you don't agree to be bound by the modified Terms, then you may no longer use the Services.

If you breach the Terms, we may take action against you, including but not limited to terminating your account and forbidding your access to the Services. Should there be any funds or monetary account balance, you acknowledge that we have no obligation to, and will not, reimburse or refund you for Services lost through involuntary suspension or termination of your account.

We provide the Service at will. You understand and agree that we provide the Service at will. We may modify, restrict, disable, or terminate the Service or any part of it, at any time and for any duration, including permanently, without appeal, at our sole discretion and without notifying you. You understand that the Service may become unavailable, in whole or in part or with respect to specific Elevator(s), at any time, due to planned maintenance, policy change, unplanned outages of any kind including software or hardware defects, and any circumstance out of our control, with our without our knowledge. We may try to notify you of planned or detected outages, but this notification may not happen or may not reach you. The Service is provided "as is," without any warranty, except where prohibited under applicable law.

Approval required. Each Elevator requires approval by the organizations or entities with authority for that Elevator's ridership, which we refer to as "your Site(s)." Each Site has its own terms, policies, conditions, and/or membership requirements for use of their Elevators. You agree to abide by the Site's terms, and discontinue your use of the Site's Elevator(s) immediately if you disagree with their terms. The Site may modify these at their discretion with or without direct notification to you. You agree to keep yourself informed of these modifications, and immediately discontinue using the Site if you disagree. The Site may change ownership, management entities, responsibilities, or staff, which may also modify the Site's terms or revoke access to the Service or specific users. The Site allows access to the Service or any user at the Site's sole discretion. Delays in approval may occur per Site policy, review, staff availability or other reasons. The Site may revoke access at any time.

The Service does not provide liason, advocacy, or direct or indirect communication with the Site on users' behalf.

Accurate information required. The Service and your Sites need truthful, accurate information about you, which we collect. This includes a verifiable email address and other personally identifying information.

Your Site(s) may collect and store your Personal Information from the Service. The Service has no responsibility over your Sites(s) storage, use, protection or dissemination of the information you provided, including publicly publishing, even after your dissociation from the Site. You agree not to hold the Service responsible the Site(s) actions, including any use or mis-use of any information you provide. The Service may preserve, internally, historical information regarding your Site(s) even after you dissociate from the Site.

We collect usage data. You understand and agree that we collect detailed data on all interactions with the Services. By using the Services, you're granting us the right to collect, store, archive, analyze, publish, share and otherwise use this data at our sole discretion, in perpetuity. While we strive to protect users' identity by anonymizing the data prior to sharing or publishing derived analyses, you understand and agree that we cannot guarantee that this anonymization cannot be reversed.

We may contact you. You grant us permission to contact you periodically, at our discretion, typically by email with news we think may interest you.

Not for emergencies. The Service is not for emergency or safety-critical situations. You agree that you will not put yourself or others in any situation where provision, interruption, and/or termination of the Service might bring anyone harm or jeopardize anyone's well-being in any way.

Appropriate use. You will only use the Service appropriately. You will only call an Elevator you are fully prepared to use. You will not use the Service to deny or hinder anyone else's use of an Elevator, either directly or indirectly. You will not use the Service to violate any law, regulation, Site policy, or these terms, and you will not encourage or enable any other individual to do so.

Your responsibility. You recognize that others could gain access the Service using your account/identity, including but not limited to voice interactions with your home portal device(s), even through locked doors. You are responsible for all uses of the Service under your identity. You agree to proactively assess your circumstances and environment and to take necessary precautions to protect all methods you use to interact with the Service, including but not limited to disabling or powering off your device(s), or suspending or terminating your access to your Site(s) or the Service. The Service may provide features or methods to help you facilitate proper use and prevent mis-use; those do not change your responsibilities.

Your equipment. You recognize and agree that you are responsible for the proper functioning of any equipment you use to interact with the Service, including but not limited to voice-interaction devices and network connections. Equipment conditions and settings, including but not limited to microphone and speaker volume levels, network access credentials, network and Internet availability, and device power are required by the Service, are your responsibility, and can change without your awareness.

Account registration. To use the Service, you must have an active account with us (an "Account"), and you will need a computer or mobile device with Internet access and browsing capability. You agree that you won't disclose your Account password to anyone and you will notify us immediately of any unauthorized use of your Account. You are responsible for all activities that occur under your Account, whether or not you know about them.

You may terminate your Account at any time by visiting our website. Upon Account or Service termination, the following provisions of these Terms will survive: Rights Granted by You, Disclaimer of Warranties, Limitation of Liability, Indemnity, Dispute Resolution, General Terms and this sentence on Termination.

You must be at least 18 years of age to use the Service.

We exclusively own all right, title, and interest in and to the Service and Content, including all associated intellectual property rights. "Content" means all text, software, scripts, graphics, photos, videos, audiovisual combinations, sounds, music, communications, interactive features, works of authorship of any kind, and other materials or information that are generated, provide, or otherwise made available through the Service. You acknowledge that the Service and Content are protected by copyright, trademark, and other laws of the United States and other countries. You agree not to remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices in or accompanying the Service or Content. Public domain, Share-alike or other general public licensed parts are used under those rights in good faith.

You agree not to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Service or Content. You agree not to deactivate, bypass, remove, or otherwise circumvent any technological measure we implement to protect the Service or Content. We reserve the right to remove or restrict any Content at any time and without notice.

Content is provided "as is," without any warranty, except where prohibited under applicable law.

Disclaimer of Warranty. THE SERVICE AND CONTENT ARE PROVIDED "AS IS," WITHOUT ANY WARRANTY, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT PERMITTED BY APPLICABLE LAW. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SERVICE AND CONTENT IS WITH YOU, INCLUDING DEFECTS IN SOFTWARE AND HARDWARE.

Limitation of Liability. UNLESS REQUIRED BY LAW, IN NO EVENT WILL THE PROVIDER OF THE SERVICE OR YOUR SITE(S) BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILTIY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY YOUR OR THIRD PARTIES OR A FAILURE OF THE SERVICE TO OPERATE WITH ANY OTHER SERVICE, HARDWARE, OR SOFTWARE, EVEN IF ANY PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

If the disclaimer of warranty and limitation of liability provided above cannot be given local legal effect according to their terms, reviewing courts shall apply local law that most closely approximates an absolute waiver of all civil liability in connection with the Service.

Dispute Resolution. YOU AGREE THAT DISPUTES WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION, AND YOU ARE WAIVING YOUR RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING. This Dispute Resolution section will survive any termination of these Terms.


Privacy Policy

We collect Personal Information and Data as you use the Services to provide and improve the Services. This section states our policies regarding our collection, use and disclosure of Personal Information and Data. Terms not defined here have the same meaning as in our Terms of Use.

We will not use or share Personal Information or Data with anyone except as described in this Privacy Policy.

We collect information on you. To provide the Service, we need truthful, accurate information about you, which we collect. This is considered Personal Information or Personally Identifiable Information, and includes a verified email address, name and other information.

We share Personal Information with your Site(s). Your Site(s) require truthful and accurate information about you as a passenger of their Elevator(s). The Service shares this information with each of your Site(s).

Log data. We collect information from your browser on each web page interaction with our website. This may include your computer's Internet Protocol address (IP address), browser type and version, the date/time and duration of each page visit and any other information available. We may also use third party services such as Google Analytics that collect and analyze this type of information. These third party services have their own privacy policies.

Cookies. Cookies are data packets exchanged between your browser and our web server(s), containing data on your web session including login status. They include an anonymous unique identifier. You may configure your browser to reject cookies or notify you about them, but our site may not work without them. We use cookies to collect information.

Service Providers. We may employ third party companies or individuals to facilitate the Services or parts thereof, to provide the Services on our behalf, to perform Service-related services or to assist us in analyzing aspects of the Services. These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Communications. Using your Personal Information, we may periodically contact you with marketing/promotional materials, newsletters or other information we think may be of interest to you. You may opt out of these communications via your account settings.

Security. The security of your Personal Information is very important to us, and we take all reasonable measures to protect it. Even so, we cannot guarantee its absolute security since no method of electronic storage or transmission is 100% secure.

International Transfer. Your Personal Information may be transferred and/or maintained on computers located outside of your state, province, country or other governmental jurisdiction, where information protection laws may differ from your jurisdiction.

Minors. Our Terms of Use require users to be at least 18 years of age. Therefore, we do not collect Personal Information on minors. If you are a parent or guardian and aware that your child has provided us with Personal Information, please remove it or contact us. If we become aware of such a situation, we will take steps to correct it.

Policy changes. We may update this Privacy Policy from time to time. The current Privacy Policy will be located at this URL, or reachable from it. You may not be actively notified of changes to it, or notifications may not reach you. Therefore, we advise you to review this Policy periodically for any changes. Policy changes are effective as of the date they are posted on this page.
